Trump Administration Demands Exclusion of Transgender Issues from Sex Education Curricula, Several Jurisdictions Agree

At least 11 states and a pair of regions have agreed to a new demand from the Trump administration to eliminate references of transgender issues and the presence of trans and non-binary people from a national sexual health program, officials stated.

The government set a Monday deadline for stripping these mentions, warning the withdrawal of millions in federal funds. Almost every of the complying states have GOP-led state legislatures and mostly GOP state leaders.

Court Battles and Financial Conflicts

Sixteen other states and Washington DC have filed a lawsuit against the administration's demand, arguing it infringes on Congressional authority, which created the $75m sexual health initiative, known as the Personal Responsibility Education Program (Prep).

Program Goals and Government Scrutiny

The program aims to educate teenagers on healthy relationships and how to prevent pregnancy and the spread of sexually transmitted infections.

In the spring, the federal government demanded all states and territories receiving program money to submit a version of their curriculum to HHS and its subsidiary, the Administration for Children and Families, for a health content assessment.

Four months later, the administration dispatched notices to numerous jurisdictions, stating that, during the review, it had found “material in the curricula that fall outside the scope of Prep’s authorizing statute.”

Specifically, the government said it had uncovered evidence of “gender ideology,” a term often used by rightwing factions to describe the notion that gender is a changeable social construct and that transgender individuals are real.

Notable Cases of Required Alterations

The government directed one state to remove a lesson that said: “Adolescents may express themselves in ways that differ from their assigned gender.”

It instructed North Carolina to eliminate a line from a educational module that stated: “Individuals regardless of identity need to know how to avoid unplanned pregnancy and infections.”

Additionally, sex educators in many jurisdictions could no longer be told to “show tolerance and understanding for all participants, irrespective of individual traits, including race, cultural background, faith, social class, sexual orientation or gender identity,” based on the letters sent to jurisdictions.

Official Statements and State Responses

“Oversight is imminent,” declared Andrew Gradison, interim leader of the ACF office, in a announcement. “Federal funds will not be used to poison the minds of the youth or advance harmful political doctrines.”

Multiple states and territories stated they would remove the content or had completed the process. These include Alaska, Georgia, Iowa, Kentucky, Mississippi, North Carolina, Oklahoma, South Carolina, Tennessee, West Virginia and Wyoming, as well as the two territories.

Another pair of jurisdictions, the states, reported their educational programs never included the terminology referenced in the government's notices.

Impact on Youth and Psychological Well-being

Collectively, these states are inhabited by over 120k transgender individuals aged 13 to 17, based on estimates from a research institute.

“When the aim is to help adolescents and give them a safe space, I’m not sure why we are stomping on the at-risk teenagers in the population,” commented an advocate, who heads Rise that offers health instruction in Tennessee.

“When the government says that there’s something incorrect about you and the educators aren’t allowed to provide information or they have to disclose your identity to family – when you know that that’s not safe – that’s horrible for mental health.”

Almost 50% of transgender adolescents seriously considered suicide in the past year, based on a recent study from a mental health organization. Educational backing for these adolescents is associated with lower rates of self-harm attempts, the group discovered.

Previous Actions and Continuing Conflicts

Previously, the federal government instructed California to remove mentions to gender identity from its Prep curriculum.

When the Democratic-led state declined, the administration revoked its funding, cutting about $12 million in federal funding and halting health initiatives in educational institutions, juvenile detention facilities and care facilities.

The state agency is challenging the termination. So far, it has been unable to make up for the withdrawn money.
